B. Braun of Canada, Ltd., a leader in smart infusion therapy, safe and effective pharmacy products, patient and provider safety and sustainable health solutions, (collectively, “B. Braun”, “we”, “our”, “us”) strives to help providers constantly improve patient satisfaction and outcomes.
This Applicant Privacy Notice and Policy (the “Notice”) describes how we collect and handle personal data of Canadian residents who are external job Applicants and potential candidates for positions with B. Braun. For the purposes of this Notice, “personal data” includes “personal information” and any other equivalent or similar expression under applicable Canadian data protection laws.
We will only collect, use, communicate, and otherwise handle or process your personal data in compliance with applicable Canadian privacy laws and regulations, including the Personal Information Protection and Electronic Documents Act (Canada), the Act respecting the protection of personal information in the private sector (Québec), the Personal Information Protection Act (Alberta), the Personal Information Protection Act (British Columbia), each as may be applicable to your situation.
Legal Basis for Processing Personal Data
B. Braun may process personal data without consent where required or permitted by applicable law. We may also rely on your consent (which may be express or implied) in accordance with applicable law as the basis for processing your personal data, where and if this is required by locally applicable law.
Notwithstanding any mention to the contrary in the Privacy Notice, if you are a resident of the province of Québec, we will only collect, use, or communicate your personal data with your consent, unless permitted by applicable law. Please note that the collection of personal data as described in the Privacy Notice is necessary to process your application and initiate or manage your eventual employment relationship with B. Braun. If you do not consent to the collection of your personal data, we may be unable to process your applications or manage your eventual employment relationship with us. You have the right to withdraw your consent to further use, communication or processing of your personal data in certain circumstances.
Personal data collected by B. Braun may be collected, used and disclosed in the course of an investigation as required or authorized by applicable law.

Subject to any specific conditions provided under applicable law, and depending on your province of residence, you have the following rights in respect of your personal data:

Retention of personal data
B. Braun will keep personal data used to make a decision affecting you for at least one year after using it to make the decision.
B. Braun will also retain personal data for the time period required for the purpose of collection or where we have a legal obligation or right to retain the data. For instance, we may maintain business records for so long as required for the purpose of their collection, and/or may have a legal obligation to hold personal data for so long as potentially relevant to prospective or actual litigation or government investigation.
B. Braun will destroy, erase or make anonymous (to the extent permitted by applicable laws) documents or other records containing personal data as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the information and retention is no longer necessary for a legal purpose, all in accordance with our retention schedules. Unless otherwise specified, we will retain your personal data for the duration of your application process, and for a period of up to 3 years afterwards.
Cross-Border International Transfers
Your personal data may be transferred outside of your jurisdiction for the purposes of our recruitment and applicant processes to B. Braun group entities and their service providers in the European Union and other jurisdictions. All such transfers will be made in accordance with applicable Canadian data protection laws. Applicable laws in other jurisdictions might permit foreign governments, courts, law enforcement or regulatory agencies to access the personal data in those jurisdictions. In these cases, B. Braun will comply with applicable local law requirements relating to the conditions for disclosure or release of personal data.
Changes
B. Braun may change or update the Candidate Privacy Notice, including these Canadian clauses, at any time. If we do so, in whole or part, any changes will be effective immediately upon communicating the revised Candidate Privacy Notice or Canadian clauses to you.
If at any time we decide to collect, use, communicate, or otherwise process your personal data in a manner significantly different from that stated in the Candidate Privacy Notice or these Canadian clauses, or otherwise disclosed to you at the time it was collected, we will notify you and obtain your consent where required before we use your personal data in the new manner.
